Description
1. Evidence was sufficient for the jury to convict appellant of attempted theft by swindle of over $35,000 even though the
profits its the state alleged the defendant would have gained through the swindle, if successful, were not ascertainable with
mathematical precision. 2. The trial court did not abuse its discretion by refusing to give appellant's proposed jury instructions on intent, the
theory of the defense, and the meaning of the term "property. The instructions taken as whole adequately explained the law
of the case and allowed defendant's counsel to argue the defense theory to the jury.
